Here are the highlights of what's included:
Liberalization Clause The current policy terms are automatically broadened whenever we adopt in the insured's state a revised CGL CG 00 01 that has broader terms without an additional premium charge.
Contractual Liability for Personal and Advertising Injury The contractual exclusion for personal and advertising injury is deleted.
Amended Defense Coverage for Indemnitees We have made it easier for defense expenses incurred on behalf of a contractual
indemnitee to be considered supplementary payments in addition to the policy limits instead of being within the policy aggregates.
Fellow Employee Coverage Employees are now insureds for acts against other employees within specified policy conditions.
Non-Owned Watercraft Covers bodily injury or property damage caused by non-owned watercraft less than 51-feet long and not being used to carry persons or property for a charge.
Broad Knowledge/Notice of Occurrence C&F now provides for accidents that are reported as workers compensation at
the time of the accident and later determined to be commercial general liability claims.
Unintentional Failure to Disclose Hazards If, as of the inception date, an insured unintentionally fails to disclose all hazards or prior occurrences, coverage will not be automatically denied.
Broad Form Named Insured/Newly Acquired Organizations Coverage is broadened to include, as named insureds, any organization that
you acquire and maintain majority control if no other insurance is available to that organization.
Mobile Equipment
C&F has broadened the definition of mobile equipment to include specified equipment under 1000 pounds.
Tenant's Legal Liability Coverage
Coverage limit for property damage to rented premises is the greater of the limit shown on the policy or $300,000.
Medical and Dental Payments
Limits increased to $15,000.
Additional Insureds by Written Contract Offers "additional insured status" to organizations you are required to add by written contract and makes this coverage primary if specified in the contract.
Supplementary Payments
C&F has increased bail bonds and loss of earnings payments available under the policy.
Additional Insured — State or Political Subdivisions Political subdivisions are automatically covered when they issue a permit to you.
This does not apply to operations performed for the governmental entity or to the products – completed operations hazard.
Mental Anguish, Mental Injury or Humiliation The definition of bodily injury now includes resulting mental anguish, mental injury or humiliation.
Incidental Medical Malpractice Liability C&F now provides “insured status” to nurses and other employees that furnish health services within the scope of their employment.
Property Damage Liability — Borrowed Equipment Coverage up to $25,000 per occurrence, $50,000 annual aggregate, is provided for equipment that you borrow, unless the property damage occurs while the equipment is being used by an insured at a job site.
Property Damage Liability — Elevators and Sidetrack Equipment This coverage has been broadened to include the use of elevators and liability assumed under sidetrack agreements.
Waiver of Transfer of Rights of Recovery Against Others to Us The insured can waive C&F's rights to recovery against others when executed under a written contract with that organization before "the Occurrence" under specific circumstances outlined in the form.
